1) Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority in your jurisdiction, you may use the App only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice within the App or by other reasonable means. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

3) License and Use of the App

Subject to your compliance with these Terms, Color Quest Studio grants you a limited, non‑exclusive, non‑transferable, revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non‑commercial use.

Restrictions

• Do not copy, modify, translate, adapt, or create derivative works of the App.
• Do not reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, except to the extent permitted by applicable law.
• Do not bypass, remove, or circumvent any security or technical measures of the App.
• Do not use the App in any manner that infringes, misappropriates, or violates any rights of any person or entity, or in any unlawful way.

Distribution platforms: Your use of the App may also be governed by the terms and policies of the platform from which you downloaded it (e.g., Apple App Store or Google Play). You must comply with those terms in addition to these Terms.

4) Accounts and Security

The App may use a pseudonymous identifier (for example, a Firebase Authentication user ID) to operate certain features. You are responsible for maintaining the security of your device and for any actions taken through your use of the App. If you believe your App use or any identifier has been compromised, contact us.

5) User Content

The App may allow you to import or generate content (for example, photos, images, coloring creations, feedback, or screenshots) (collectively, "User Content"). You retain any rights you hold in your User Content. You grant Color Quest Studio a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, and display your User Content solely as necessary to operate and provide the App and support.

Your responsibilities

• You represent that you have all rights necessary to submit or use User Content in the App and that your User Content does not infringe any third‑party rights or violate any law.
• Do not submit User Content that is illegal, harmful, violent, pornographic, hateful, or otherwise objectionable, or that promotes the same.
• We may remove or disable access to User Content that we believe violates these Terms or applicable law.

6) Acceptable Use

• Do not interfere with or disrupt the operation of the App (including by introducing malware or engaging in scraping, rate‑limiting evasion, or abusive automated activity).
• Do not attempt to gain unauthorized access to any systems or data.
• Do not use the App to collect or harvest information about others in violation of law.
• Do not impersonate any person or entity or misrepresent your affiliation with any person or entity.

7) Third‑Party Services and Links

The App may include integrations with or links to third‑party services (for example, analytics, ads, content delivery, or websites). We are not responsible for third‑party services, their content, or their practices. Your use of third‑party services is governed by their terms and privacy policies.

8) Advertising

The App may be supported by in‑App advertising. Ads are provided by third‑party partners and may be based on device or contextual information. See our Privacy Policy for details about how we use analytics and advertising technologies and your choices.

9) Intellectual Property

The App, including its software, features, text, graphics, images, trademarks, logos, and other materials, are owned by or licensed to Color Quest Studio and are protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are granted to you by implication or otherwise.

10) Feedback

If you submit ideas, suggestions, or feedback about the App ("Feedback"), you agree that we may use the Feedback for any purpose without compensation or obligation to you.

11) Disclaimers

The App and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the App will be uninterrupted, error‑free, secure, or free of harmful components.

Your use of the App is at your own discretion and risk. Some jurisdictions do not allow the exclusion of certain warranties; to the extent such laws apply, the above exclusions may not apply to you.

12) Limitation of Liability

To the maximum extent permitted by law, Color Quest Studio and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App.

To the maximum extent permitted by law, our aggregate liability for all claims relating to the App will not exceed the greater of (a) the amounts you have paid to us (if any) for the App during the twelve (12) months prior to the event giving rise to the claim, or (b) USD $10.

Some jurisdictions do not allow limitations of liability; to the extent such laws apply, the above limitations may not apply to you.

13) Indemnification

You agree to defend, indemnify, and hold harmless Color Quest Studio and its affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App or your violation of these Terms or applicable law.

14) Termination

We may suspend or terminate your access to the App at any time if we believe you have violated these Terms or for any reason in our discretion. Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination will survive (including, without limitation, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).

15) Governing Law

These Terms and your use of the App are governed by the laws applicable in your place of residence to the extent required by law. Where not prohibited, the laws of the United States will apply, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the App will be brought in a competent court with jurisdiction, unless applicable law provides you with mandatory rights to bring claims elsewhere.

16) Changes to the App

We may modify, suspend, or discontinue all or part of the App at any time, with or without notice. We will not be liable if any part of the App is unavailable at any time or for any period.
